These Terms of Service govern your access to and use of jumpstartready.com, any related websites, online stores, features, content, communications, products, and services operated by Jump Start Ready LLC.

In these Terms, “Jump Start,” “we,” “us,” and “our” refer to Jump Start Ready LLC. “You” and “your” refer to any visitor, customer, account holder, or other user of our website or services.

By accessing our website, creating an account, submitting an order, enrolling in a subscription, or otherwise using our services, you agree to these Terms and to the policies incorporated into them.

If you do not agree to these Terms, do not use the website or purchase our products.

The following policies are incorporated into these Terms by reference:

If an offer, product page, checkout disclosure, or separate written agreement contains terms that specifically conflict with these general Terms, the more specific terms will control for that transaction, except where prohibited by law.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a purchase or create an account without the involvement of a parent or legal guardian.

By using the website or placing an order, you represent that:

  • You have the legal capacity to enter into a binding agreement

  • The information you provide is accurate and complete

  • You are authorized to use the payment method submitted

  • Your use of the website and products complies with applicable law

Our products are intended for adults unless the applicable product label expressly states otherwise.

3. Online Store and Website Provider

Our online store is hosted through Shopify and may use Shopify or other third-party providers to process transactions, host content, manage subscriptions, provide communications, detect fraud, and support other store functions.

Your use of certain third-party features may also be governed by the applicable provider’s terms and privacy practices.

4. Product Information

We attempt to describe and display our products accurately. However, packaging, appearance, color, texture, flavor, dimensions, and other characteristics may vary slightly between production runs or from how they appear on a screen.

Product photographs are provided for illustrative purposes. Your device, display settings, lighting, and other factors may affect how images appear.

We may update product ingredients, packaging, quantities, formulations, directions, warnings, or specifications when appropriate. The information printed on the product packaging you receive should be followed when it differs from older website content or promotional materials.

Normal variations in flavor, color, texture, packaging, appearance, or dissolving time are not necessarily product defects.

5. Dietary Supplement and Caffeine Notice

Certain products sold by Jump Start are dietary supplements and contain caffeine or other dietary ingredients

These products are not intended to diagnose, treat, cure, or prevent any disease. Statements concerning dietary supplements have not been evaluated by the Food and Drug Administration.

Always read and follow the product label, directions, ingredient information, dosage instructions, and warnings before use.

Do not exceed the recommended serving. Consider all other sources of caffeine you consume, including coffee, tea, soda, energy drinks, medications, supplements, and other products.

Consult a qualified healthcare professional before using a product if you:

  • Are pregnant or nursing

  • Are sensitive to caffeine

  • Have a medical condition

  • Take prescription or nonprescription medication

  • Have been advised to restrict caffeine or supplement use

  • Have questions about whether the product is appropriate for you

Discontinue use and seek appropriate medical attention if you experience a serious or unexpected reaction.

Do not use any product whose individual wrapper, seal, or packaging appears opened, punctured, damaged, or compromised.

Keep out of reach of children. Do not provide the product to a child unless its use has been approved by an appropriate healthcare professional and is consistent with the product label.

6. No Medical Advice

The website, product descriptions, articles, videos, social media content, emails, testimonials, frequently asked questions, and other materials are provided for general informational and commercial purposes.

They are not medical advice and are not a substitute for diagnosis, treatment, or advice from a physician or other qualified healthcare professional.

Information about the experience of one customer does not guarantee that another customer will have the same experience.

Do not disregard professional medical advice or delay seeking it because of information provided by Jump Start.

7. Orders

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.

We may accept, reject, limit, hold, or cancel an order when reasonably necessary, including because of:

  • Product availability

  • Pricing or listing errors

  • Payment authorization problems

  • Suspected fraud or unauthorized activity

  • Address or shipping restrictions

  • Quantity limitations

  • Suspected resale or commercial redistribution

  • Legal or regulatory requirements

  • Violation of these Terms

  • Other operational or security concerns

If we cancel an order before shipment, we will issue an appropriate refund for amounts collected for the canceled items.

We may limit quantities purchased per person, account, payment method, household, billing address, shipping address, or order.

Products are sold for personal use unless we expressly approve a wholesale, resale, distribution, or commercial arrangement in writing.

8. Order Information

You are responsible for providing accurate, current, and complete information when placing an order or maintaining an account.

This includes:

  • Name

  • Email address

  • Billing address

  • Shipping address

  • Apartment or unit information

  • Telephone number, when requested

  • Payment details

You are responsible for reviewing your order before submitting it.

Requests to modify or cancel an order are governed by our Shipping Policy and Refund and Return Policy. We will attempt to accommodate timely requests but cannot guarantee that an order can be changed after submission.

9. Prices

Prices, product availability, promotions, and offers may change at any time before an order is submitted.

A price change does not affect an order that we have already accepted, except when:

  • The price resulted from an obvious typographical, technical, or listing error

  • The order is modified by agreement

  • Applicable law permits or requires an adjustment

  • A discount, promotion, or eligibility condition was applied incorrectly

Prices displayed before checkout may not include shipping charges, sales tax, or other charges that depend on the order and destination. Applicable charges will be displayed during checkout when required.

We do not guarantee that prices offered through different retailers, marketplaces, advertisements, promotions, affiliates, or sales channels will be identical.

10. Payment

You authorize us and our payment providers to charge the payment method submitted for:

  • The products ordered

  • Applicable shipping charges

  • Applicable taxes

  • Subscription renewals you have authorized

  • Other charges clearly disclosed and accepted during checkout

You represent that you are authorized to use the payment method provided.

Payment information is processed by third-party payment providers. We do not necessarily receive or store your complete payment card information.

An order may be delayed, held, or canceled if payment cannot be authorized, appears fraudulent, or requires additional verification.

11. Taxes

You are responsible for applicable sales, use, excise, or similar taxes imposed on your purchase, except for taxes imposed directly on Jump Start’s income.

Taxes are generally calculated based on the information available during checkout and applicable legal requirements.

12. Subscriptions and Automatic Renewals

When you enroll in a subscription, you authorize recurring charges at the price, frequency, and terms disclosed during enrollment.

Before submitting a subscription order, review:

  • The products included

  • The recurring price

  • The billing frequency

  • Any initial discount

  • When the first and future charges will occur

  • How to modify or cancel the subscription

  • Any minimum purchase or commitment terms, if applicable

Unless otherwise disclosed, subscriptions continue until canceled.

You are responsible for canceling or modifying a subscription before the applicable processing or renewal deadline. Canceling a subscription stops future eligible renewals. It does not automatically cancel or refund an order that has already been processed, charged, fulfilled, or shipped.

Subscription prices, products, quantities, or benefits may change. When required, we will provide notice and obtain any consent required by applicable law before applying a material change to future renewals.

You may cancel through the subscription-management method provided on our website or by contacting hello@jumpstartready.com.

Subscription returns and refunds are governed by our Refund and Return Policy.

13. Promotions and Discount Codes

Promotions, giveaways, discount codes, referral offers, affiliate codes, bundles, gifts with purchase, and free-shipping offers may be subject to separate conditions.

Unless expressly stated otherwise:

  • Promotions cannot be combined

  • Discounts have no cash value

  • Promotions may be limited to one use per customer, account, household, address, or payment method

  • Promotions may exclude certain products, subscriptions, destinations, or prior purchases

  • Promotional eligibility may be verified

  • Promotions may be modified or ended before an order is placed

  • Discounts cannot be applied retroactively to completed purchases

We may reject, cancel, or adjust an order involving unauthorized, fraudulent, manipulated, duplicated, or improperly obtained promotional benefits.

We will not retroactively remove a valid promotion from an accepted order merely because the promotion later changes or ends.

14. Gift Cards and Store Credit

Gift cards and store credits may be used only as permitted by the terms accompanying them.

They are not redeemable for cash except where required by law.

Lost, stolen, deleted, or misdirected gift cards may not be replaceable. We may require reasonable proof of purchase or ownership before replacing or restoring a balance.

Promotional credits may expire where legally permitted and when the expiration is properly disclosed. Paid gift cards remain subject to applicable gift card laws.

15. Shipping and Delivery

Order processing, available shipping destinations, shipping charges, carriers, delivery estimates, tracking, incorrect addresses, carrier delays, missing packages, damaged shipments, and returned-to-sender packages are governed by our Shipping Policy.

Delivery dates are estimates unless a specific guaranteed service is expressly offered.

16. Returns, Refunds, and Guarantee

Returns, refunds, replacements, damaged products, incorrect products, exchanges, the 101-Day Guarantee, and standard return eligibility are governed by our Refund and Return Policy.

The 101-Day Guarantee applies only as described in that policy and does not create a warranty that every customer will experience a particular result.

17. Preorders and Backorders

Products identified as preorders or backorders will be handled according to the availability information displayed during purchase and our Shipping Policy.

Estimated availability and shipment dates may change.

If a delay requires notice, consent, cancellation rights, or a refund under applicable law, we will provide the required options.

18. Accounts

Certain features may allow or require you to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • Restricting access to your device and account

  • Providing accurate account information

  • Promptly notifying us of suspected unauthorized access

  • Activity occurring through your account, except where caused by our failure to use reasonable security measures

We may suspend, restrict, or close an account associated with fraud, abuse, security concerns, policy violations, unauthorized resale, or unlawful activity.

19. Acceptable Use

You may not use the website, services, or content to:

  • Violate any law or regulation

  • Commit or facilitate fraud

  • Submit false, misleading, or impersonated information

  • Infringe intellectual property, privacy, publicity, or other legal rights

  • Harass, threaten, abuse, or unlawfully discriminate against another person

  • Upload or transmit malicious code

  • Circumvent website security

  • Interfere with website operation

  • Access accounts or systems without authorization

  • Scrape, crawl, harvest, or systematically extract website information without permission

  • Send spam or unauthorized messages

  • Manipulate reviews, referrals, promotions, discounts, or affiliate tracking

  • Make purchases using stolen or unauthorized payment information

  • Resell products without authorization when authorization is required

  • Use the website or products for an unlawful or unauthorized commercial purpose

We may investigate suspected misuse and take reasonable action, including restricting access, canceling orders, preserving records, or cooperating with payment providers, carriers, platforms, or legal authorities.

20. Intellectual Property

The website and its contents are owned by, licensed to, or used with permission by Jump Start Ready LLC.

Protected content may include:

  • Packaging

  • Photographs

No license or ownership interest is transferred to you by your use of the website.

21. Reviews, Feedback, and User Content

You may be able to submit reviews, comments, photographs, videos, testimonials, questions, ideas, or other materials.

You retain ownership of content that you own. By submitting content to us or through a feature intended for public display, you grant Jump Start a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify for formatting, publish, display, distribute, and use that content in connection with our website, products, advertising, social media, and business operations. To the extent included in the submitted content, this permission also includes the use of your name, username, social media handle, image, likeness, and voice.

This license continues for as long as the content is used or retained in our materials, subject to applicable law.

You represent that:

  • You own the content or have permission to submit it

  • The content is truthful and based on your genuine experience when presented as a review or testimonial

  • The content does not violate another person’s rights

  • The content does not contain unlawful, defamatory, deceptive, threatening, obscene, or malicious material

  • Any material connection, compensation, free product, discount, or incentive has been disclosed when required

We may remove, decline, edit for formatting, or choose not to publish content. We are not obligated to publish or respond to submissions.

We will not materially alter the meaning of a customer review in a misleading way.

Do not submit confidential business information, product ideas, formulas, inventions, or other information you expect us to treat as confidential unless we have first agreed in writing to confidentiality.

22. Copyright and Intellectual Property Complaints

If you believe content on our website infringes your copyright, trademark, or other intellectual property rights, contact:

  • Identification of the protected work

  • Identification and location of the allegedly infringing material

  • A description of your rights

  • A statement that you have a good-faith belief the use is unauthorized

We may remove or restrict access to disputed content while reviewing a complaint.

23. Third-Party Services and Links

The website may include links to or features supplied by third parties, including payment providers, subscription platforms, social networks, review platforms, analytics providers, shipping carriers, and other service providers.

We do not control independent third-party websites, products, policies, availability, security, or content.

A link or integration does not necessarily mean we endorse every statement, product, or practice of the third party.

Your use of third-party services is subject to the terms and privacy practices of those providers.

24. Privacy

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy.

Submitting information through the website does not, by itself, constitute consent to receive promotional text messages.

Marketing email and text consent will be requested separately where required. You may unsubscribe from marketing emails using the unsubscribe option provided and may opt out of promotional text messages by replying STOP.

You may continue to receive nonmarketing communications that are necessary to complete transactions, provide requested services, respond to you, protect accounts, address safety issues, or comply with law.

Consent to receive marketing communications is not a condition of purchase unless expressly permitted and disclosed by applicable law.

25. Errors and Corrections

The website may occasionally contain typographical errors, technical errors, outdated information, inaccuracies, or omissions involving:

We do not guarantee that the website or every feature will always be available, uninterrupted, secure, or error-free.

We may update, suspend, restrict, remove, or discontinue website features, products, content, or services.

This does not eliminate obligations relating to orders already accepted or rights that cannot be waived under applicable law.

27. Disclaimer of Warranties

To the fullest extent permitted by law, the website and online services are provided on an “as available” basis.

Except for express commitments contained in our Refund and Return Policy, Shipping Policy, product labeling, or another written warranty provided by us, we disclaim warranties relating to the website and services to the fullest extent permitted by law.

This may include implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Nothing in these Terms excludes warranties, protections, or remedies that cannot legally be disclaimed.

The results experienced from dietary supplements, caffeine, or other products vary between individuals. We do not guarantee a specific physical, mental, productivity, energy, alertness, flavor, or lifestyle result.

28. Limitation of Liability

To the fullest extent permitted by law, Jump Start Ready LLC and its officers, employees, contractors, affiliates, service providers, suppliers, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the website or services.

This may include lost profits, lost revenue, lost data, loss of business opportunity, or similar losses.

To the fullest extent permitted by law, our aggregate liability arising from the website, an order, or these Terms will not exceed the greater of:

  • The amount you paid to Jump Start for the product or transaction giving rise to the claim

  • One hundred dollars

These limitations and liability caps do not apply to liability that cannot legally be excluded or limited, including liability for death or personal injury caused by conduct for which liability cannot legally be limited, fraud, willful misconduct, gross negligence where it cannot be limited, or other nonwaivable rights under applicable law.

Nothing in these Terms limits a valid claim arising from a defective, contaminated, adulterated, or improperly labeled product when applicable law does not permit that claim or remedy to be limited.

29. Product Misuse

Jump Start is not responsible for harm caused solely by:

  • Using a product contrary to its label or directions

  • Exceeding the recommended serving

  • Consuming the product despite a known allergy or contraindication

  • Combining it with other caffeine sources or substances contrary to medical advice or product warnings

  • Using damaged or compromised products after being warned not to do so

  • Improper storage

  • Unauthorized alteration

  • Providing the product to someone for whom it is not appropriate

This section does not excuse Jump Start from responsibility imposed by applicable law for manufacturing defects, contamination, inaccurate labeling, failure to provide legally required warnings, or other matters that cannot legally be disclaimed.

30. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Jump Start Ready LLC and its officers, employees, contractors, affiliates, agents, and service providers from third-party claims, losses, liabilities, and reasonable legal expenses arising from:

  • Your unlawful use of the website

  • Your material violation of these Terms

  • Content you submit

  • Your infringement of another party’s rights

  • Fraudulent or unauthorized conduct performed through your account

This obligation does not apply to claims caused by Jump Start’s own unlawful conduct, negligence, product defect, or breach of these Terms.

31. Suspension and Termination

You may stop using the website at any time.

We may suspend or terminate access to the website or an account when reasonably necessary because of:

  • A material violation of these Terms

  • Fraud or suspected fraud

  • Unauthorized access

  • Threats to website security

  • Abuse of promotions or policies

  • Unlawful conduct

  • Risk to customers, Jump Start, or third parties

Termination does not eliminate rights or obligations that arose before termination.

Provisions concerning payment, intellectual property, user content, disclaimers, liability, indemnification, governing law, and dispute resolution survive when their nature requires survival.

32. Force Majeure

Jump Start will not be liable for a delay or failure to perform caused by circumstances outside our reasonable control, including:

  • Severe weather

  • Natural disasters

  • Fire

  • War

  • Terrorism

  • Civil disorder

  • Government orders

  • Public health emergencies

  • Labor disruptions

  • Transportation interruptions

  • Carrier failures

  • Utility failures

  • Internet or platform outages

  • Cyberattacks

  • Supply chain disruptions

  • Shortages of materials

  • Failure of a critical service provider

This section does not eliminate any cancellation, notice, refund, or other right required by applicable law.

33. Governing Law

These Terms and disputes arising from them are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any court proceeding that is not subject to another legally required forum may be brought in a state or federal court located in New York.

Nothing in this section prevents a consumer from pursuing a claim in another forum when applicable law gives the consumer a nonwaivable right to do so.

34. Informal Dispute Resolution

Before filing a lawsuit, the parties are encouraged to attempt to resolve the dispute informally.

We will make reasonable efforts to review and respond.

This informal process does not prevent either party from filing a claim when necessary to preserve a legal deadline, seek emergency relief, use small claims court, dispute an unauthorized payment, or exercise another nonwaivable right.

35. Severability

If a provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the greatest extent permitted or severed when necessary.

The remaining provisions will continue in effect.

36. No Waiver

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Jump Start.

37. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the Jump Start business, subject to applicable law.

38. Entire Agreement

These Terms and the policies incorporated into them constitute the agreement between you and Jump Start concerning the website, services, and purchases covered by them.

They replace prior versions of the Terms concerning those matters.

They do not override separate written agreements concerning wholesale arrangements, affiliates, creators, vendors, employees, contractors, or other business relationships.

39. Changes to These Terms

We may update these Terms by posting a revised version on this page and updating the “Last updated” date.

Unless otherwise required by law, revisions will apply prospectively to use of the website and orders placed after the revised Terms are posted.

The Terms and policies in effect when an order was placed will generally continue to govern that order.

We may apply revised terms to an earlier order when the revision is more favorable to the customer.

When legally required, we will provide additional notice or obtain consent before applying a material change.
